Background and geography

  • 1549–1550: the Real Audiencia de Santafé (Nuevo Reino de Granada) is installed. The Real Audiencia series now held by the AGN begin in 1551 (Cortés). The south (Pasto, much of the Gobernación de Popayán) answered to the Audiencia de Quito. That is why there are records of southern Colombians in Ecuadorian archives and in the Quito section of the AGI. (Creation dates to be confirmed with the legal source.)
  • 1717 / 1723 / 1739: The Viceroyalty of New Granada is created, abolished, and finally restored. It covered present-day Colombia, Panama, Ecuador, and Venezuela (Venezuela became a separate captaincy general in 1777). Files of the viceregal government are in the AGN, Sección Colonia, and in the AGI, Gobierno section, "Audiencia de Santa Fe".
  • 1810–1819: Independence. The Audiencia’s papers were damaged in 1817, when the building was used as a barracks (Cortés).
  • 1819–1831: Gran Colombia (Cundinamarca/New Granada, Venezuela, and Quito). Venezuela and Ecuador broke away in 1830. Files from those countries are in Bogotá, and vice versa.
  • 1832–1858: Republic of New Granada, organized into provinces. 1858–1863: Granadine Confederation, with federated states. 1863–1886: United States of Colombia, with nine sovereign states that had their own civil laws, including civil registration. 1886: Republic of Colombia, with departments.
  • 1903: Panama separates. Colonial and 19th-century papers on the isthmus remain in the AGN in Bogotá.
  • Successor archive: The decree of 17 January 1868 created the Archivo Nacional and brought together the archives of the government secretariats. The archive moved to the Biblioteca Nacional in 1935–1937 ("Archivo Histórico de la Biblioteca Nacional") and into the BNC building in 1939 (Cortés). Ley 80 de 1989 [Law 80 of 1989] created the current Archivo General de la Nación (Wikipedia). The AGN’s "Sección Archivo Anexo" comes from the former Biblioteca Nacional (DataViva portal).
  • Losses: The archdiocesan archive of Bogotá burned on 9 April 1948 (document from the Universidad Santo Tomás). Church records for the capital survive mainly in the Archivo Capitular de la Catedral Primada and in the AGN’s "Curas y Obispos," "Conventos," and "Capellanías" fondos.
  • Civil registration: in the 19th century each federal state legislated on its own. In the 20th century civil registration was handled by notaries and mayors. The FamilySearch catalog entry for the Notaría Primera de Valledupar says its books "include civil registration from 1861–1887, and generally before 1936". Practical consequence: notarial records (protocols) serve both as a secondary source and as a repository of early civil registration. (The exact laws, 1852 and Law 92 of 1938, are to be confirmed.)
  • Territories that passed to other countries: Venezuela and Ecuador (1830), Panama (1903), plus later border adjustments. For these areas, also check the national archives of those countries.
  • Regional archives: Regional and local archives exist; researchers should find out what exists in the locality.
  • Real Audiencia de Santafé: "In 1549 (July) the royal audiencia of New Granada was created; it was installed in 1550 (April)" (Mendoza Morales, Boletín de la Sociedad Geográfica de Colombia, 1988–1989). The exact installation day does not appear in that source.
  • Viceroyalty of New Granada: created by royal decree of 27 May 1717, abolished by royal decree of 5 November 1723, and re-established in 1739 (Ruigómez Gómez, Fronteras de la Historia, 2017; Toro Silva, AHDE, 2021). Mendoza Morales (1988–1989) speaks of a hiatus between 1724 and 1740; see “Contradictions between sources”.
  • Separation of Venezuela (1830): "El 22 de septiembre el Congreso de Venezuela sanciona su Constitución como república independiente" (Mendoza Morales, 1988–1989). The 1903 separation of Panama appears in the same source, with no day.
  • Civil marriage (1853): New Granada’s civil marriage law dates from 1853. The same article gives two dates, 20 June and 20 July (Andrade Córdoba and Andrade Córdoba, Nueva Época, 2017); see “Contradictions between sources”.
  • Civil Code of 1873 and Ley 57 de 1887: The 1873 Civil Code made civil registration a state function, but in practice parish entries continued to serve as proof. Ley 57 de 1887, art. 22, accepts parish priests’ certificates as "pruebas principales del estado civil" (Muñoz Calderón and Zuluaga Gil, national report for the UN, after 1991).
  • Decreto 540 de 1934 [Decree 540 of 1934]: Registration is assigned to notaries and, where there is no notary, to the secretaries of municipal councils (Muñoz Calderón and Zuluaga Gil).
  • Ley 92 de 1938 (26 May; Diario Oficial 23.803 of 15 June 1938): "por la cual se dictan algunas disposiciones sobre registro civil y cementerios". Registers are kept by notaries, by the mayor where there is no notary, and by consuls abroad (art. 1). The law "regirá desde su promulgación" (art. 20). Civil registration copies become the main proof for later events (art. 18). Without them, parish entries are accepted as supplementary proof, then witnesses, and as a last resort, notorious possession of status (art. 19) (text of the law, MinSalud PDF).
  • Decreto 1260 de 1970 (27 July): "por el cual se expide el Estatuto del Registro del Estado Civil de las personas". The officials in charge are notaries, municipal registrars or mayors in municipalities without a notary’s office, and consuls abroad (art. 118). Art. 105 governs proof of events before and after Ley 92; if entries are missing, "instrumentos públicos o […] copias de partidas de origen religioso" are accepted (text of the decree, UGPP PDF). The decree makes registration the "única prueba del estado civil" (Muñoz Calderón and Zuluaga Gil).
  • Transfer to the Registraduría: Ley 96 de 1985 orders the Registraduría Nacional to take over civil registration gradually from 1 January 1987. Decreto 1028 de 1989 transfers to it the Servicio Nacional de Inscripción, formerly under DANE. The 1991 Constitution (art. 266) entrusts the Registrar with "la dirección y organización del registro civil" (Muñoz Calderón and Zuluaga Gil). In practice, registrations from 1938 to 1987 are mostly in notaries’ offices and mayors’ offices; later ones are increasingly at the Registraduría.
  • 1852 civil registration law: No verifiable institutional information was found during this research (3 separate searches). Do not cite it in the wiki until the text or a scholarly work supports it.
  • Naturalization (Ley 22 de 1936, Diario Oficial 23.109): The Executive issues the naturalization certificate (carta de naturaleza) (art. 13), with the involvement of the Ministry of Foreign Affairs (arts. 8 and 12). The Ministry keeps a register of naturalized persons with age, marital status, "el nombre de su mujer," and the name, age, and sex of children under 21 (art. 16). In addition, "se publicará en el Diario Oficia[l] la noticia correspondiente sobre cada carta de naturalización" (art. 21). The law was repealed by Ley 43 de 1993, art. 38 (Normograma of the Cancillería).
