Context and geography

  • 1511/1526: Real Audiencia de Santo Domingo [Royal Court of Santo Domingo], the first in the Americas. At various times its district covered much of the Caribbean and the Tierra Firme mainland. Much of the government documentation is kept at the AGI (Seville), Santo Domingo section, not on the island. The AGN has digital copies of that section: there is a record with the old call number "Santo Domingo, 994", from 1786-1790 (verified at colecciones.agn.gob.do).1
  • 1795, Treaty of Basel: Spain cedes the eastern part of the island to France. The Audiencia and part of the colonial papers left for Cuba around 1799-1800 (general context, to be confirmed in this research). This helps explain why the AGN has few colonial fonds.
  • 1801: the occupation by Toussaint Louverture introduces a registry of births, marriages, and deaths under French law. With the return to Spain, the earlier system comes back (Reyes Vásquez, vLex).
  • 1809-1821, "España Boba": Spanish sovereignty returns. The notaries who would work during the Haitian period were already practicing in these years (González Canalda, 2014).
  • 1821: short-lived independence ("Estado Independiente de Haití Español" [Independent State of Spanish Haiti]), from December 1821 to February 1822.
  • 1822-1844, Haitian unification or occupation: the French Civil Code is in force, in French, and civil records are kept by "alcaldes constitucionales" [constitutional mayors]. Around 1825, public and notarial acts written in Spanish are invalidated (Núñez, Acento 2026). The AGN Protocolos Notariales fonds has 3,857 cataloged acts from 1822-1844.
  • 27 February 1844: independence. The French Civil Code remains in force, in French. In 1853 the alcaldes constitucionales are confirmed as civil registrars.
  • 1861-1865, annexation to Spain: a Real Decreto [Royal Decree] of 7 October 1861 provisionally keeps the civil laws in force. The records of the Spanish administration are mainly at the AHN (Madrid), Ultramar section, and in Spanish military archives. The Restoration begins in 1863, and Spanish troops leave in 1865.
  • 1905-1941, Receptoría de Aduanas [Customs Receivership] under U.S. control. According to NARA, most of its papers are at the AGN in Santo Domingo (RG 139).
  • 1916-1924, U.S. occupation: the AGN fonds "Gobierno Militar de Santo Domingo, 1916 a 1924" is described item by item.
  • 1930-1961, Trujillo Era: fonds of the Secretarías de Estado [government ministries], residence permits from 1940-1954, and heavy immigration (Spanish Republican exiles of 1939-1940).
  • Civil registration: it has existed since 1801/1822 under French law. Ley 659 of 17 June 1944 on Actos del Estado Civil sets up the current system, and Ley 8-92 (13 April 1992) transfers the Oficialías del Estado Civil [civil registry offices] to the Junta Central Electoral. FamilySearch has civil births from 1828 held by the AGN. Secondary sources are essential, above all before 1828 and for foreigners and immigrants.
  • Territory: the border with Haiti changed (for example, the area of Hincha, Las Caobas, and San Rafael, which was Spanish in colonial times and is Haitian today). There may be records for these places in Haiti or at the AGI (general context, to be confirmed here).
  • Regional and local archives exist (for example, the Archivo Real del Seibo, published by the AGN). Researchers should find out what exists in each locality.

National archives and institutions

Only national archives and institutions and key foreign repositories are included. There are also regional, municipal, diocesan, and religious-order archives: find out what exists in your ancestor’s locality.
